Terms & Conditions

  1. Payment by you of a deposit shall be deemed to be an acknowledgement of reading and acceptance of the conditions of any booking or travel arrangements made with Top Tours & Travel.

  2. Top Tours & Travel may cancel, suspend or postpone any scheduled departure or vary arrangements of any travel if in its absolute discretion it decides that the welfare of any person is at risk due to war terrorism, unrest, or other perceived dangers, strikes or other causes beyond Top Tours & Travel’s reasonable control. In such an event Top Tours & Travel shall not be liable for any loss or damage arising there from.

  3. Top Tours & Travel will not accept responsibility for any injury, loss, or damage howsoever caused outside of Australia and all such travel shall be at the customers’ own risk.

  4. Top Tours & Travel does not own, manage, control or operate any airlines, bus operators, shipping operators, hotel operators, arrange charters and make catering arrangements. The providers of such services are not agents of Top Tours & Travel but are independent contractors over whom Top Tours & Travel has no control and Top Tours & Travel accepts no responsibility for any claims, for damage, injury, delays, or loss of any nature arising out of, or incidental thereto.

  5. Top Tours & Travel advises that overseas travel may involve risks and uncertain outcomes over which Top Tours & Travel has no control, which the customer accepts and acknowledges.

  6. Top Tours & Travel under no circumstances will be liable for any loss or damage whatsoever which may result from any use or inability to use, or failure to avail of any goods or services, accommodation, tour, or other benefit provided by, or arranged through or by Top Tours & Travel.


Participants in our tour packages are encouraged to travel with an open mind, active curiosity and thoughtful courtesy to others. We believe that it is very important to maintain a positive attitude towards the people of the host country, their culture and way of life. Lodging and meals, particularly away from large metropolitan cities, may vary and be different from what you are used to at home. Enjoy them with a spirit of adventure, which is the reward of foreign travel. Top Tours & Travel reserves the right to refuse service and/or terminate the participation of any tour participant whose health or mental condition or physical infirmity impedes the operation of the tour, or whose conduct is discourteous to others. Top Tours & Travel welcomes passengers with disabilities or special needs provided they are accompanied by a companion capable of providing all assistance required. Any special requirements must be advised at time of booking. Top Tours & Travel reserves the right to refuse to carry any people who it deems cannot fully care for themselves on tour without assistance. You acknowledge that some cruise ships not have elevators and where there is an elevator onboard it will not access all decks. Cabins and bathrooms have significant thresholds and cabin doors and restrooms are not wide enough to allow access by standard wheelchairs. Wheelchairs and walkers cannot be carried on coaches, due to space limitations. Wheelchair passengers should be aware of these limitations. We regret that we cannot provide individual assistance to a passenger for walking, dining, getting on and off coaches or other transportation vehicles, or other personal needs. A qualified companion must accompany travellers who need such assistance. Top Tours & Travel reserves the right to refuse service and/or terminate the participation of any tour participant whose health or mental condition or physical infirmity impedes the operation of the tour, or whose conduct is discourteous to others.


In the event that currency fluctuations affect the price of the booking, we reserve the right to adjust our prices as necessary at anytime prior to full payment being made.


If you purchase a promotional offer, separate terms and conditions will apply. Payment in full is required at time of booking unless otherwise stated. If you opt to pay by direct deposit, then payment is required within 24 hours. Receipt needs to be emailed to sales@toptours.com.au otherwise booking will be cancelled. Promotional offers are non-refundable therefore travel insurance is highly recommended. Subject to review, change of travel date is permitted onto another tour. Additional charges will apply. 


A non-refundable deposit of $1000.00 per person is required within 7 days of the booking being made otherwise booking is subject to cancellation. Balance is due 90 days prior to departure unless stated otherwise. For bookings made within 90 days of departure, full payment is required at the time of confirmation. Credit Card fees will apply to any payments.


All cancellations must be made in writing. The following is an indication of the cancellation fees:

Over 90 days: $1000.00 per person per tour- 90-60 days: 50% of total – 59 days - day of departure: 100% of total. Airline cancellation fees will apply in addition to the non-refundable deposit paid to Top Tours and Travel. No refund is granted for unused accommodations, meals, or if cruise ships alter their itineraries. Any changes to original booking will incur a fee of $150 plus any additional fees imposed by the airline.


Airport taxes and charges are subject to change until airfare portion is paid in full. Once payment has been made for airfare portion, any changes to airfare will incur a fee if flights are available. Top Tours & Travel recommends airfare portion to be paid in full 7 days after confirmation to avoid paying any increase in taxes and charges imposed by the airline. Taxes and charges are subject to change within the 7 days of advanced payment date. If you decide to pay in full for the airfare portion prior to 60 days of departure, fees will apply in case of cancellation in addition to the non-refundable deposit. Any airfares booked outside the tour package must also be paid in full within 7 days after confirmation. Conditions of airline taxes and charges apply to all airfares booked through Top Tours & Travel. If airfare portion is being paid by cheque, taxes are as of the day cheque is cleared by Top Tours & Travel’s bank and therefore if airline taxes and charges increase during this period you will be required to pay the increased amount. If airfare potion is being direct deposited into our account, a receipt needs to be presented to our office on the day payment was made. If this is not done taxes will be as of the day it is shown in Top Tours & Travel’s account. If there is an increase in taxes during this time, you will be required to pay the increased amount. Please note, depending on airfare purchased Frequent Flyer points may not be accruable with selected airlines.


At the time of booking your consultant will advise you of the payment due date. Until full payment has been received, Top Tours and Travel will hold no responsibility if your flight booking is automatically cancelled. Changes to flight itineraries may result in penalties charged by the airline on top of the charge from Top Tours & Travel, these are the guests responsibility. All airfares and routings are subject to change at any time until full payment is received and air tickets are issued. Airlines may impose penalties of up to 100% of the air ticket value, if you cancel your airfare for any reason please check with your consultant at the time of booking. Availability of seats are limited and may not be available on every flight and every tour departure date. Airline Seating - We can request a window or an aisle seat for you once your ticket has been issued however this is on a request basis only and seats are subject to change until you have checked in for your flight. Exit row seas cannot be pre-arranged this may only be done upon check in on the day of your flight. With the exception of some airlines that charge you per person/per flight to book the exit row, this however must be arranged direct through the airlines website. Seat and meal requests may be requested at the time of booking, Top Tours and Travel does not assure the request will be granted. Frequent Flyers may be accrued with most airlines it is the clients responsibility to advise if you have a membership at the time of booking. Top Tours & Travel shall not be responsible for matters relating to frequent flyer miles. Top Tours & Travel is not responsible for any time changes, re scheduling of flights or flight cancellations which are caused by the airlines any additional costs that may incur at the clients expense, Travel Insurance is recommended as you may be able to recover some costs. 

Top Tours and Travel days on their air and land packages may sometimes change depending on flight availability. Therefore its possible for your tour to be shortened or extended by a day or two however the land content will remain the same. 


We strongly recommend full comprehensive travel insurance. Travel Insurance is not active until paid in full. It is your responsibility to advise our office if you wish to cover any pre-existing health conditions on your insurance policy. Travel Insurance rates quoted and/or invoiced are subject to change until insurance is paid in full. Please check with your doctor for recommended vaccination requirements.


The tour price does not include tipping, departure taxes and charges imposed by a third party. Passports, Visas, vaccinations, excess baggage, and meals not included in the itinerary, optional excursions and all items of a personal nature, such as, telephone calls, laundry and beverages unless stated otherwise.


Final documents, vouchers, air tickets (if package is purchased as an air/land package) and general material will be forwarded approximately 2 to 3 weeks prior to departure provided final payment has been received.


No refund is given for services not utilised. Hotels or Cruise ship specified on the itinerary may be altered for similar if necessary. Hotels advertised are subject to change to similar standard. Tour itinerary is also subject to change. Due to unforeseen circumstances beyond our control, Top Tours & Travel reserves the right to substitute hotels and cruise ships and to alter itineraries.


If Top Tours & Travel has made any bookings outside of their Tours it is your responsibility to obtain the wholesalers name and their booking terms and conditions, which you must abide by once a deposit has been made.


If you have booked a travel package through a third party (e.g Scoopon, Luxury Escapes, Bon Voyage Travel, Groupon or similar), you will be required to abide by their booking conditions and conditions. Any changes to the third party package will incur a fee of $200 per person per change.  


Top Tours & Travel is not itself a carrier or hotelier, nor do we own aircraft, hotels or coaches. The services that Top Tours & Travel supplies consist of arranging and coordinating accommodation, tours and transfers, making bookings and issuing vouchers to be redeemed by suppliers. We exercise every care in the selection of reputable airlines, tour operators, coach operators, hotels and other suppliers of the various travel services used in these tours. It is important to note, therefore, that all bookings with Top Tours & Travel are subject to the terms and conditions and limitations of liability imposed by airlines, coach operators, hoteliers, and other service providers including but not limited to shipping, rail, car hire and restaurant operators, whose services we utilise, some of which limit or exclude liability in respect of death, personal injury, delay and loss of damage of baggage. We always do our best to ensure your holiday arrangements are satisfactory, and we accept liability for, but only to the extent of, any loss or damage sustained by you as the result of our negligence, or that of our employees or agents. However Top Tours & Travel does not accept any liability of whatever nature for the acts, omissions or default whether negligent or otherwise, of those airlines, coach operators, shipping and cruise companies, hoteliers or other persons providing services in connection with your tour arrangements pursuant to a contract between themselves and yourself (which may be evidenced in writing by the issue of a ticket, voucher, coupon or the like) and over which Top Tours & Travel has no direct and exclusive control. Top Tours & Travel does not accept responsibility in contract or in tort (actionable wrong) for any injury, damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by force majeure or other events which is beyond its control, or which are not preventable by reasonable diligence on the part of Top Tours & Travel, including but not limited to war, civil disturbance, fire, flood, unusually severe weather, acts of god, acts of government or any other authorities, accidents to, or failure of machinery or equipment, or industrial action (whether or not involving our employees and even though such actions may be settled by acceding to the demands of a labour group)


You should familiarize yourself with any health or visa requirements that may be applicable in the areas that you intend visiting, and you shall be responsible for all entry, exit, health and other documents required by law, regulations orders, demands or requirements of the countries visited or transited. You shall carry a valid passport at all times. Passport, visa and vaccination requirements are not our responsibility and we are not liable for any loss or expense due to your failure to comply with the above. It remains your responsibility to ensure that these documents are in order and to meet any additional costs incurred, as a result of failure to comply with such requirements. You accept that you may be travelling through areas of political or climatic instability, high altitude and remote areas of political or climatic instability, high altitude and remote areas without proper medical services, and accept the associated risks. The making of a booking constitutes your acceptance of all booking terms and conditions as described herein and forms the basis of your contract with Top Tours & Travel.
